2024 could be a turning point for the regulation of AI in health care

Toward the end of the year, CMS finalized rules that prevent insurers from using internal algorithms to deny care. The rules also require insurers to disclose more information about the inner workings of their tools. But whether that disclosure will be sufficient, and how CMS will penalize violators, will be key outcomes to watch in 2024. A similar dynamic is unfolding with AI models supplied to hospitals by electronic health record (EHR) vendors. The Office of the National Coordinator for Health Information Technology finalized a rule in December that requires EHR sellers to explain how the models they supply are trained and tested — and what steps they’ve taken to mitigate risks.
