This Quick Stats page displays data on claims or suggestions of possible information blocking<sup><a href=\"#footnote-1\">1<\/a><\/sup>&nbsp;ONC has received through the Report Information Blocking Portal since April 5, 2021 \u2013 the applicability date of the information blocking regulations.<\/p>\n\n\n\n<p>To best understand and use the information provided, it will be important to keep the following in mind:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Information provided about the perspectives of those submitting claims and the types of potential actors alleged to be information blocking is based solely on an ONC analyst\u2019s inference from the facts and allegations as presented by the claimant.<\/li>\n\n\n\n<li>Any claim ONC receives is simply an allegation or suggestion that information blocking has occurred. Logging a portal submission as a claim does&nbsp;<em><strong>not&nbsp;<\/strong><\/em>imply that an investigation has occurred or been started, or that any determination has been made as to whether information blocking has occurred.<\/li>\n\n\n\n<li>Where a claim alleges or suggests that conduct implicating the information blocking definition in&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-D\/part-171\/subpart-A\/section-171.103\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-processed wpel-icon-right\">45 CFR 171.103<i class=\"wpel-icon fa fa-external-link\" aria-hidden=\"true\"><\/i><\/a>&nbsp;could possibly have occurred, any determination as to whether an information blocking actor\u2019s conduct met the information blocking definition or not would require a fact-based, case-by-case investigation and review against all elements of the information blocking definition. Resources available include fact sheets, recorded webinars, and frequently asked questions about the information blocking regulations.<\/li>\n\n\n\n<li>The Cures Act authorizes the HHS Office of Inspector General (OIG) to&nbsp;<a href=\"https:\/\/healthit.gov\/wp-content\/uploads\/2025\/05\/Information-Blocking-Portal-Process.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" class=\"wpel-no-icon wpel-processed\" data-wpel-link=\"external\">investigate<\/a>&nbsp;any claim of information blocking.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-tertiary-color has-text-color has-link-color has-medium-font-size wp-elements-f5aa4319f8189ff16590c5bacf16ae54\" style=\"padding-top:var(--wp--preset--spacing--60)\"><strong>Information on submissions received through the Report blocking.\n<ul class=\"wp-block-list\">\n<li>Within a given claim, the claimant may be identified by more than one category.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>\u201cPatient\u201d in this context means an individual who appears to be seeking or to have sought access to their&nbsp;<a href=\"https:\/\/healthit.gov\/wp-content\/uploads\/2025\/02\/Understanding_EHI.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" class=\"wpel-no-icon wpel-processed\" data-wpel-link=\"external\">electronic health information<\/a>.<\/li>\n\n\n\n<li>The \u201cAttorney\u201d label is added to a claim in addition to one of the other types of claimant categories. For example, a claim submitted by someone describing themself as an attorney on behalf of their client, who is a patient, would be counted in both the &#8220;Patient&#8221; and &#8220;Attorney&#8221; type of claimant categories.<\/li>\n\n\n\n<li>A \u201cHealth Care Provider\u201d claimant is one who describes themselves as such in the claim, or who an analyst infers, based on what they state in the claim, could potentially meet the definition of health care provider in&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-D\/part-171\/subpart-A\/section-171.102#p-171.102(Health%20care%20provider)\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-processed wpel-icon-right\">45 CFR 171.102<i class=\"wpel-icon fa fa-external-link\" aria-hidden=\"true\"><\/i><\/a>.<\/li>\n\n\n\n<li>A claim from a &#8220;Third Party on Patient&#8217;s Behalf&#8221; is one that reads as having been submitted by someone other than the patient who is not presenting or describing themself as an attorney. For example, a claim submitted by the parent of a patient on the patient&#8217;s behalf would be counted in this category.<\/li>\n\n\n\n<li>A \u201cHealth IT Developer\u201d claimant is one who describes themselves as such, or otherwise appears from what is stated in the claim to develop health information technology (as \u201chealth information technology\u201d is defined in&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2020-title42\/pdf\/USCODE-2020-title42-chap6A-subchapXXVIII-sec300jj.pdf\" class=\"wpel-no-icon wpel-processed\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">42 U.S.C. 300jj(5)<\/a>).<\/li>\n\n\n\n<li>\u201cUnknown\u201d means ONC analysts were not able to infer the type of claimant from the facts and allegations as presented in the claim.<\/li>\n\n\n\n<li>An HIN\/HIE claimant is one who describes themselves as such in the claim, or who an analyst infers, based on what they state in the claim, could potentially meet the definition of a health information network or health information exchange in&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-D\/part-171\/subpart-A\/section-171.102#p-171.102(Health%20information%20network%20or%20health%20information%20exchange)\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-processed wpel-icon-right\">45 CFR 171.102<i class=\"wpel-icon fa fa-external-link\" List<\/a>.<\/li>\n\n\n\n<li>&#8220;Non-Actor&#8221; means that the individual(s) or entity\/entities alleged by the claimant to be possibly information blocking does not appear to potentially fall within any of the defined categories of information blocking&nbsp;<a href=\"https:\/\/healthit.gov\/wp-content\/uploads\/2025\/06\/IB_Actors_Fact_Sheet_508.pdf\" target=\"_blank\" rel=\"noreferrer One example of a \u201cnon-actor\u201d would be a company described as providing internet services where there is no indication or suggestion that the company also does anything that could cause it to meet the definition of a HIN\/HIE or \u201chealth IT developer of certified health IT\u201d as defined in&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-D\/part-171\/subpart-A\/section-171.102\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-processed wpel-icon-right\">45 CFR 171.102<i class=\"wpel-icon fa fa-external-link\" aria-hidden=\"true\"><\/i><\/a>.<\/li>\n\n\n\n<li>\u201cUnknown\u201d means a particular type of potential actor could not be inferred from the facts and allegations as presented by the claimant.<\/li>\n\n\n\n<li>\u201cNon-CHPL-listed Health IT Developer\u201d means the claim identifies an entity that is not listed in the \u201cDeveloper\u201d column of the&nbsp;<a href=\"https:\/\/chpl.healthit.gov\/\" data-wpel-link=\"internal\">Certified Health IT Product List<\/a>&nbsp;but the entity appears from the facts and allegations as presented by the claimant to develop or offer health information technology (as that term is defined in&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2020-title42\/pdf\/USCODE-2020-title42-chap6A-subchapXXVIII-sec300jj.pdf\" class=\"wpel-no-icon wpel-processed\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">42 U.S.C. 300jj(5)<\/a>).<\/li>\n\n\n\n<li>A potential HIN\/HIE actor is an entity that is described as such in the claim, or who an analyst infers, based on what the claimant states in the claim, could potentially meet the definition of a health information network or health information exchange in&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-D\/part-171\/subpart-A\/section-171.102#p-171.102(Health%20information%20network%20or%20health%20information%20exchange)\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-processed wpel-icon-right\">45 CFR 171.102<i class=\"wpel-icon fa fa-external-link\" aria-hidden=\"true\"><\/i><\/a>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-footnotes\">Footnotes<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li id=\"footnote-1\">[1]<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2020-title42\/pdf\/USCODE-2020-title42-chap6A-subchapXXVIII-partC-sec300jj-52.pdf\" class=\"wpel-no-icon wpel-processed\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">42 U.S.C. \u00a7 300jj\u201352<\/a>: Any information that is received by the National Coordinator in connection with a claim or suggestion of possible information blocking and that could reasonably be expected to facilitate identification of the source of the information\u2014(A) shall not be disclosed by the National Coordinator except as may be necessary to carry out the purpose of this section;
