{"id":16916,"date":"2020-12-16T10:30:18","date_gmt":"2020-12-16T15:30:18","guid":{"rendered":"https:\/\/healthit-gov.go-vip.net\/buzz-blog\/?p=16916"},"modified":"2026-01-06T15:42:17","modified_gmt":"2026-01-06T15:42:17","slug":"pssst-information-blocking-practices-your-days-are-numberedpass-it-on","status":"publish","type":"post","link":"https:\/\/healthit.gov\/blog\/insights-updates\/pssst-information-blocking-practices-your-days-are-numberedpass-it-on\/","title":{"rendered":"Pssst\u2026Information blocking practices, your days are numbered\u2026Pass it on."},"content":{"rendered":"\n<p>Passed four years ago, the 21<sup>st<\/sup> Century Cures Act (Cures Act) included a definition of \u201cinformation blocking.\u201d On behalf of the HHS Secretary, the Office of the National Coordinator for Health Information Technology (ONC) was tasked with implementing this definition and its \u201cexceptions.\u201d The new regulation (also a \u201claw\u201d) published in the Federal Register this past May by ONC identified three types of participants in health care that are covered under information blocking: 1) health care providers, 2) health IT developers of certified health IT, and 3) health information networks (HINs)\/health information exchanges (HIEs). We call them \u201cactors\u201d for short.<\/p>\n\n\n\n<p>Through the Cures Act, Congress defined information blocking and established penalties for those who engage in information blocking. In general, actors can no longer engage in practices that interfere with the access, exchange, or use of electronic health information unless the practices are required by applicable law(s) or if an actor meets an \u201cexception\u201d established by the HHS Secretary. My companion blog post \u201c<a href=\"https:\/\/healthit.gov\/buzz-blog\/information-blocking\/to-share-or-not-to-share-whats-an-exception-to-information-blocking\" target=\"_blank\" rel=\"noreferrer noopener\">To share or not to share, what&#8217;s an exception (to information blocking)<\/a>?\u201d unpacks the <a href=\"https:\/\/healthit.gov\/wp-content\/uploads\/2024\/04\/IB_Exceptions_Fact_Sheet_508.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">exceptions<\/a> we established in the Cures Act Final Rule to address privacy, security, and a host of other issues.<\/p>\n\n\n\n<p>We recently issued an <a href=\"https:\/\/healthit.gov\/information-blocking\/\" target=\"_blank\" rel=\"noreferrer noopener\">interim final rule<\/a> with comment period that extended the deadline for when the information blocking regulation applies to \u201cactors\u201d to April 5, 2021. The details and legal nuances associated with the information blocking law can be a lot to take in. So, here\u2019s a different way to think about the law, especially if you\u2019re one of the \u201cactors.\u201d<\/p>\n\n\n\n<p><em>In health care and except for limited circumstances, an actor cannot engage in a practice that would be considered information blocking, unless required by law or an exception is met. <\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-four-information-blocking-basics\"><strong>Four Information Blocking Basics<\/strong><\/h2>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-1-congress-made-the-law-about-the-data\">#1: Congress made the law \u201cabout the data\u201d <\/h4>\n\n\n\n<p>Electronic health information (EHI) to be specific. The law does <em>not<\/em> distinguish between ONC-certified and other health IT when it comes to EHI. In other words, the law applies to the access, exchange, and use of EHI no matter what technology is used by actors. This <a href=\"https:\/\/healthit.gov\/oncs-cures-act-final-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">fact sheet<\/a> identifies the differences between the proposed rule and final rule and includes summaries of the EHI definition as well as the definitions for \u201caccess,\u201d \u201cexchange,\u201d and \u201cuse.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-2-don-t-forget-state-and-other-laws\">#2: Don\u2019t forget state and other laws. <\/h4>\n\n\n\n<p>For example, if an actor is <em>prohibited <\/em>under state law from sharing certain EHI, they are not caught in a catch-22. The state law applies and, therefore, the actor does not need to also meet a regulatory exception to information blocking for the EHI that the state law prohibits sharing.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-3-information-block-who-me\">#3: Information block!? Who\u2026me? <\/h4>\n\n\n\n<p>The information blocking law applies expansively to the three types of actors. I\u2019ll briefly unpack who they are and how (here\u2019s a <a href=\"https:\/\/healthit.gov\/wp-content\/uploads\/2025\/06\/IB_Actors_Fact_Sheet_508.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">fact sheet<\/a> for all three).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Who\u2019s a \u201chealth care provider\u201d when it comes to information blocking?<br><\/em>There are many definitions for \u201chealth care provider\u201d that are specific to the law in which the term is referenced. In the case of information blocking, Congress amended Title XXX of the Public Health Service Act (PHSA). As such, the PHSA definition applies. The \u201chealth care provider\u201d definition that\u2019s part of Title XXX of the PHSA includes a wide range of providers of care throughout the health care system\u2014from hospitals to renal dialysis facilities to laboratories to pharmacies. Here\u2019s a link to the <a href=\"https:\/\/healthit.gov\/oncs-cures-act-final-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">full fact sheet on the definition<\/a><span style=\"font-size: inherit;letter-spacing: -0.001em\">.<\/span><\/li>\n\n\n\n<li><em>Who\u2019s a \u201chealth IT developer of certified health IT\u201d when it comes to information blocking?<br><\/em>This one\u2019s \u201ceasy\u201d to point out, but there is some added detail to keep in mind. Any health IT developer with one or more Health IT Modules certified under the ONC Health IT Certification Program is covered by the information blocking law. But that\u2019s not all. Someone who does not initially develop but does <a style=\"font-size: inherit;background-color: #ffffff;letter-spacing: -0.001em\" href=\"https:\/\/www.federalregister.gov\/d\/2020-07419\/p-1741\"><em>offer<\/em><\/a><span style=\"font-size: inherit;letter-spacing: -0.001em\"> one or more certified Health IT Modules to others, such as by resale or other arrangement potentially including donation of software or services, is also a \u201chealth IT developer of certified health IT.\u201d<\/span><\/li>\n<\/ul>\n\n\n\n<p>Notably, the information blocking rules apply to a health IT developer of certified health IT <a href=\"https:\/\/www.federalregister.gov\/d\/2020-07419\/p-1724\">across the developer\u2019s entire business and product line(s)<\/a>. This means that such developers are accountable for their information blocking practices associated with all of their technology offerings, including those products that are not ONC-certified.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Who\u2019s an HIN\/HIE when it comes to information blocking?<br><\/em>Besides naming HINs\/HIEs as covered by the information blocking law, Congress did not provide additional direction about who these actors were or could be. As a result, and to implement the law, we included a definition for HIN\/HIE in the ONC Cures Act Final Rule that focused on the functions performed by an individual or entity with EHI that would make them an HIN\/HIE. This means that there isn\u2019t an explicitly named set of HINs\/HIEs. Rather, the HIN\/HIE definition accommodates different business models, business descriptions, and information sharing arrangements.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-4-penalties-identified-and-established-for-information-blocking-vary-by-actor\">#4: Penalties identified and established for information blocking vary by actor.<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the information blocking law, Congress established that health IT developers of certified health IT and HINs\/HIEs would be subject to penalties of up to $1M per violation for engaging in information blocking. It\u2019s also worth noting that health IT developers of certified health IT are subject to an \u201cinformation blocking\u201d Condition of Certification under the ONC Health IT Certification Program.<\/li>\n\n\n\n<li>Health care providers are treated differently under the law. A health care provider who engages in information blocking may be subject to \u201cappropriate disincentives,\u201d as set forth by the HHS Secretary.
